TERMS OF AGREEMENT AND CONDITIONS OF USE OF THE

MÔNICA MOBILE PREPAID INTERNET SIM CARD  - VERSION 14 – ENGLISH

THE PURPOSE OF THIS AGREEMENT IS TO REGULATE THE CONDITIONS APPLICABLE TO THE CONTRACTING, USE AND CANCELLATION OF SPECIFIC SERVICES AND BENEFITS OFFERED BY NEWSKY (“SERVICES”) THROUGH A MONTHLY SUBSCRIPTION. PLEASE READ CAREFULLY THE TERM AND ALL CONDITIONS CONTAINED BELOW. IF YOU DO NOT AGREE, TOTALLY OR PARTIALLY, WITH THE PRESENT TERM, AS WELL AS ANY ADDITIONS, CHANGES OR UPDATES, THE CUSTOMER WILL NOT BE ABLE TO ACCESS THE SERVICES.

a) MÔNICA MOBILE PREPAID INTERNET CHIP, internet SIM CARD with DoCoMo area coverage or Softbank available wherever there is 4G/3G. A very high quality system for better portability, communication and satisfaction.

To receive SMS is free, but sending is charged at ¥30 per message to Japan and ¥150 for international messages. Charges will be made between 30˜90 days after use, be aware of this period. As a courtesy, NewSky will provide up to 5 free SMS monthly within Japan only, domestic delivery.

4. PAYMENT METHODS

PAYDAY: BETWEEN THE 1ST and 15TH OF THE CURRENT MONTH

KONBINI

CREDIT CARD

For payment in KONBINI you need to provide us with a valid E-MAIL.

Provide the data during the service.

The customer will receive a new code in their email every month. Payment instructions will be in your email.

Make sure you have enough balance on your credit/debit card from the 5th. We recommend that you have at least ¥2,000 more in your account on the day of the debit or enough credit.

BETWEEN THE 16TH AND THE 25TH IT IS POSSIBLE TO PAY LATE WITH A FINE OF ¥1,000.

 IF YOU DO NOT PAY BY THE 25TH, YOUR SIM WILL BE CANCELED AT 11:59 PM ON THE LAST DAY OF THE MONTH. IT IS NOT POSSIBLE TO PAY AFTER THE 25TH AND YOU WILL HAVE TO HIRE A NEW CHIP.

Billing Fee: I am aware that for promotional reasons, currently the payment fee [konbini/credit card] of ¥220 is being paid by NewSky, and may be added to the invoice at any time without notice.

5. CHANGE OF PLAN

a) It is possible to increase or decrease the amount of GB within your plan. For this, request the change until the 05th for it to be changed in the following month. A fee of ¥2,000 must be paid for the change to be processed; If paying via credit card, please contact us 30 days in advance.

b) To request a change in the payment method, the customer must contact our call center at least 30 days in advance.

c) It is not possible to change between different operators or between data and data with SMS, for this, a new contract must be opened.

6. IMPORTANT INFORMATION

a) The customer must own or acquire a SMARTPHONE, UNLOCKED TABLET or DOCOMO or Softbank device with a 3G/4G system;

b) There is no daily internet usage limit, and after reaching the contracted DATA pack, the speed will be reduced to 128 Kbps by the end of the month. Normal speed will return on the first day of the month if the service has been renewed; the plan is described in your invoice.

c) Receiving SMS is free, but sending is charged at ¥30 per message to Japan and ¥150 for international messages. Charges will be made between 30˜90 days after use, be aware of this period. As a courtesy, NewSky will provide up to 5 free SMS monthly within Japan only, domestic delivery. We recommend using applications such as WhatsApp, Messenger, Skype, etc.;

7. CONTRACT

a) MONTHLY contract, but if you participate in any promotion, add to those rules described in your note.

b) In case of change of address or telephone number, the customer must inform NewSky immediately. Registration data must always be up to date;
d) NewSky's communication with customers is carried out via SMS, Facebook, WhatsApp, email, telephone or by sending a letter;

e) The SIM card is not transferable. If the customer transfers the SIM card to third parties, it may suffer legal consequences;

f) NewSky reserves the right to pass on to the customer any alterations requested by the operator without prior notice, including value adjustments;

g) If you end the contract with NewSky and leave pending items, e.g., non-payment for sending SMS, and do not ensure resolution upon immediate payment of the amounts, the client's documents and general information will be sent to the Libra Legal Advocacy office Office, being responsible for the case from that moment on; in addition, your name may be registered with the CREDIT PROTECTION OFFICE in Japan and abroad.

8. LOSS OR THEFT

a) In the event of loss or theft, the customer must notify NewSky immediately;

b) To replace the SIM card there will be a fee of ¥5,500. The replacement will be made within 3-6 business days.

9. CANCELLATION

ACCORDING TO THE PAYMENT METHODS BELOW

JUST DON'T MAKE THE INVOICE PAYMENT.

THE CUSTOMER MUST CONTACT OUR CALL CENTER AT LEAST 30 DAYS IN ADVANCE. If you do not notify us, the service will continue to be charged and there is no refund.

IF YOU HAVE SENT MORE THAN 5 (five) SMS, THE FEE WILL BE CHARGED LATER, GENERALLY BETWEEN 30 AND 60 DAYS AFTER USE, AND MUST BE PAID IMMEDIATELY VIA KONBINI OR CREDIT CARD AFTER NOTIFIED BY OUR COMPANY.

10. RIGHT OF SUSPENSION

a) If you have financial disputes with NewSky, it reserves the right to suspend any additional service on behalf of the holder until the disputes are resolved;

b) NewSky reserves the right to unilaterally suspend or cancel the customer's contract, if it causes damage to the company or in case the company deems bad use or misconduct by the customer, without prior notice and without compensation;

11. DATA TRAFFIC

a) Please be informed that as of January 2016, Japanese data traffic control laws have become increasingly strict. New rules from operators or the government may occur without prior notice. For more details, visit: bit.ly/ns_pirataria

c) In case of suspension of the service due to accidents, unscheduled maintenance, emergencies or force majeure, there will be no type of compensation for the time of unavailability of the service;

f) Internet speed can vary significantly depending on time of day, network congestion and user environment (such as terminal device specifications);

12. SUPPORT

a) NewSky does not support and is not responsible for software and applications used by the customer;

b) NewSky Mobile uses the DoCoMo or Softbank network, but all support is exclusively offered by NewSky, DoCoMo or Softbank are exempt from liability;

c) Service for technical support or questions regarding payment will only be resolved within the working hours of the responsible department: Monday to Friday from 10:00 am to 5:00 pm (closed on Sundays and national holidays);
