TERMS OF CONTRACT AND CONDITIONS OF USE OF THE TURMA DA MÔNICA PRO CHIP

VERSION 15 – ENGLISH

THE PURPOSE OF THIS AGREEMENT IS TO REGULATE THE CONDITIONS APPLICABLE TO THE CONTRACTING, USE AND CANCELLATION OF SPECIFIC SERVICES AND BENEFITS OFFERED BY NEWSKY (“SERVICES”) THROUGH A MONTHLY SUBSCRIPTION. PLEASE READ CAREFULLY THE TERM AND ALL CONDITIONS CONTAINED BELOW. IF YOU DO NOT AGREE, TOTALLY OR PARTIALLY, WITH THE PRESENT TERM, AS WELL AS ANY ADDITIONS, CHANGES OR UPDATES, THE CUSTOMER WILL NOT BE ABLE TO ACCESS THE SERVICES.

2. SERVICE

a) Turma da Mônica Pro prepaid internet chip, a very high quality system for better portability, communication and satisfaction.

2.1. IMPORTANT INFORMATIONS

a) The customer must own or purchase an UNLOCKED SMARTPHONE or TABLET device with a 3G/4G system;

b) No alteration (cutting, forced adaptation, among others) in the SIM CARD format is allowed, it will be considered as damage to the SIM card;

c) NewSky's communication with customers is carried out via SMS, Facebook, WhatsApp, email, telephone or letter;

Upon reaching 100 GB, the signal will be cut off or slowed down. The service will automatically return at the beginning of the next month if the invoice is paid; There is no daily usage limit, but uninterrupted use frequently above 5 GB may cause a speed reduction, signal cut without prior notice and even the cancellation of the contract at the request of the operator or the Japanese government;

For payment in KONBINI you need to provide us with a valid E-MAIL.

Provide the data during the service.

The customer will receive a new code in their email every month. Payment instructions will be in your email.

Make sure you have enough balance on your credit/debit card on the 9th as the card is charged. We recommend that you have at least ¥2,000 more in your account on the day of the debit or sufficient credit.

IT IS POSSIBLE TO MAKE A DELAY PAYMENT BETWEEN THE 16TH AND THE 25TH WITH A FEE OF ¥1,500 ON THE MONTHLY VALUE.

IF PAYMENT IS NOT MADE BY THE 25TH, YOUR CONTRACT WILL NOT BE RENEWED AND WILL BE ABANDONED, AND FEES AND FINES WILL APPLY, IF ANY. SEE CANCELLATION CLAUSE.

BILLING FEE: I am aware that for promotional reasons, the payment fee [konbini/credit card] of ¥220 is currently being paid by NewSky, and may be added to the invoice at any time without notice.

5. ALTERATION OF PAYMENT METHOD

a) To request a change in the form of payment from Konbini to credit card or vice versa, the customer must contact our call center, at least 30 days in advance.

6. CONTRACT

MONTHLY PLAN

a) Necessary documents for the contract: copy of valid Zairyu card or my number, front and back with updated address; copy of PASSPORT (pages 1 and 2) or driver's license; In case of change of address or telephone number, the customer must inform NewSky immediately. Registration data must always be up to date;
c) The SIM card is not transferable. If the customer transfers the SIM card to third parties, it may suffer legal consequences;

d) NewSky reserves the right to pass on to the customer any alterations requested by the operator without prior notice, including value adjustments;

7. LOSS OR THEFT

a) In the event of loss or theft of the SIM card, the customer must notify NewSky immediately;

b) To replace the SIM card there will be a fee of ¥5,500 + shipping, if any, to replace a new SIM card. The replacement will be made between 3-6 business days.

8. CANCELLATION

MONTHLY CONTRACT

NO CANCELLATION FEE

To cancel the service, the holder must contact NewSky and request the cancellation of the service.

The SIM card must be returned by the 3rd of the month following the last month paid, or there will be a fee of ¥500 per day of delay.

The customer must pay the sums that are owed to NewSky within the stipulated period, up to the 25th day after the date of payment of the monthly fee.

The due amounts must be paid in KONBINI or credit card, according to the contracted plan. For billing through KONBINI or credit card, once the billing has been launched, if there is a need to issue a new billing or change the payment date, there will be a fee of ¥1,500 added to the fine amount.

IF THERE IS A RENTED APPLIANCE - CONFIRM IT IN YOUR INVOICE

THE DEVICE MUST BE RETURNED BY THE 3RD MONTH OF THE MONTH YOU DO NOT WISH TO USE THE SERVICE, WITH A DAILY FINE OF ¥500 FROM THE 4TH DAY UNTIL THE DATE OF RESOLUTION OF THE PENDING OR RECEIPT OF THE DEVICE AT OUR CENTER. IN CASE OF RETURN OF THE RENTED APPLIANCE WITH DAMAGES OR THERE IS LOSS OF THE DEVICE, A FEE OF ¥10,000 WILL BE CHARGED.

CONTRACT ABANDONMENT DATE: DAY 25

In the event of an unfulfilled annual contract or contract with a rented device, non-payment of the monthly fee by the 15th of the month of payment and lack of interest or lack of communication with NewSky, fines will be applied referring to clauses not complied with by the client, which will be collected by our legal representative, the Advocacia Libra Legal Office and/or Trade's Creditor Protection Co.ltd. being responsible for the case from that moment and, depending on the case, a lawsuit will be opened in the court of law in the jurisdiction of Tokyo. The customer's documents and general information will be used for settlement by legal means, and in addition, his name may also be registered with the CREDIT PROTECTION OFFICE in Japan and abroad. Any legal disputes will be resolved with the Tokyo Court of Justice.

9. RIGHT OF SUSPENSION

a) If you have financial disputes with NewSky, it reserves the right to suspend any additional service on behalf of the holder until the disputes are resolved;

b) NewSky reserves the right to unilaterally suspend or cancel the customer's contract, if it causes damage to the company or in case the company deems misuse or misconduct by the customer, without prior notice and without compensation;

10. DATA TRAFFIC

a) Please be informed that from January 2016 the Japanese laws for data traffic control became more and more strict. New rules from operators or the government may occur without prior notice. For more details, visit: bit.ly/ns_pirataria

b) In case of suspension of the service due to accidents, unscheduled maintenance, emergencies or force majeure, there will be no type of compensation for the time of unavailability of the service;

c) Internet speed can vary significantly depending on time of day, network congestion and user environment (such as end device specifications);

11. SUPPORT

a) NewSky does not support and is not responsible for software and applications used by the customer;

b) NewSky Mobile uses the SOFTBANK network, but all support is exclusively offered by NewSky, SOFTBANK is exempt from liability;

c) Service for technical support or questions regarding payment will only be resolved within the working hours of the responsible department: Monday to Friday from 10:00 am to 5:00 pm (closed on Sundays and national holidays);
