TERMS OF AGREEMENT AND CONDITIONS OF USE MONICA WIFI PREPAID

THE PURPOSE OF THIS CONTRACT IS TO REGULATE THE CONDITIONS APPLICABLE TO THE CONTRACTING, USE AND CANCELLATION OF SERVICES AND BENEFITS OFFERED BY NEWSKY SPECIFIC (“SERVICES”) THROUGH A MONTHLY SUBSCRIPTION. PLEASE READ THE TERMS AND ALL CONDITIONS BELOW CAREFULLY. IF YOU DO NOT AGREE, IN WHOLE OR PART, WITH THESE TERMS, AS WELL AS WITH ANY ADDITIONS, CHANGES OR UPDATES, THE CUSTOMER WILL NOT BE ABLE TO ACCESS THE SERVICES.

4 PURCHASE OR RENTAL OF THE MONICA WIFI ROUTER DEVICE

5. PAYMENT: DATES, FORMS AND DEADLINES

A. If you do not make the payment within the deadline, your contract will not be renewed and will be canceled. Fees and fines will apply, if any. | ||
B. For late payments, when traded within the maximum term until the 25th of the same month, there will be a fee of ¥1,500. If payment is not made within this date, the service will not be renewed and will be canceled. | ||
C. If you wish to change the payment method from CONVENIENCE STORE to CREDIT CARD or vice versa, the customer must contact our call center at least 30 days prior to the payment date. | ||

6. CHANGE OF PLAN
A. To request a change of plan, make the request with our central until the 5th so that the change is made for the next month. Plan change fee amount is ¥3,300 and you can choose from available plans. After payment of the change, it will take effect from the first day of the following month if the monthly fee is paid.
7. CONTRACT CANCELLATION AND ABANDONMENT

A. To cancel the service, the holder must contact NewSky and request the cancellation of the service. | |
B. The customer must pay the amounts owed to NewSky within the stipulated period within the maximum period until the 25th day after the date of payment of the monthly fee. | |
C. The amounts due must be paid by CONVENIENCE STORE or credit card, according to the contracted plan. For billing by CONVENIENCE STORE or credit card, once the charge is posted, if there is a need to launch a new charge or change the payment date, there will be a fee of ¥1,500 added to the fine. | |

E. In case of annual contract not yet fulfilled or contract with rental device, non-payment of the monthly fee until the 15th of the month of payment and lack of interest or lack of communication with NewSky, fines related to clauses not complied with by the customer will be applied, which will be charged by our legal representative, the Libra Legal Office and/or Trade's Creditor Protection Co.ltd. being from that moment responsible for the case and, according to the case, a case will be opened in the court of justice in the jurisdiction of Tokyo. The customer's documents and general information will be used for resolution by legal means, and in addition, your name may also be registered with the CREDIT PROTECTION SERVICE in Japan and abroad. Any legal disputes will be resolved with the Tokyo Court of Justice. | |
8. CONTRACT, DATA TRAFFIC & SUSPENSION RIGHTS
A. Please be advised that as of January 2016, Japanese data traffic control laws have become stricter and new rules from operators or the government may occur without prior notice. Restrictions on the volume of data traffic may apply.
B. We provide adequate data capacity for general use, but from a fair usage and network quality maintenance point of view, usage restriction may apply to users communicating in large quantities, downloading large files, very long videos, etc. In these cases, measures can be taken, such as interrupting the communication or greatly decreasing the communication speed.
C. Customers who consume large amounts of data need to be careful. * Will not be refunded or exchanged, etc. in case suspension measures or speed restrictions are applied by the operator or the government. NewSky is not responsible for signal failures in some areas.

E. In case of delay or abandonment of a service contract, if the customer has another active service, NewSky reserves the right to suspend the other service without prior notice.
F. NewSky reserves the right to unilaterally suspend or cancel the customer's contract, if it causes damage to the company or in case the company deems misuse or misconduct on the part of the customer, without prior notice and without compensation, and may still have fines and fees applied.
G. We recommend that you do not make any changes to the router's settings, the device is already configured and ready for use.
H. In case of suspension of the service due to accidents or unscheduled maintenance, there will be no reimbursement for the time of service unavailability.
I. NewSky reserves the right, in case of any change in the service by the operator, to pass on this change to the customer without prior notice, complying with the rules required, including price readjustments.
J. Prepaid service with automatic renewal. Once the payment is made, the service is automatically renewed and there is no possibility of refunding the money.
K. The maximum communication speed of the device and service are maximum values based on technical standards and do not necessarily represent speeds in actual use. Internet speeds while in use may vary due to user environment (such as terminal device specifications) and network congestion.
L. The collection of pending items or debts can also be done abroad and the customer can have his name included in the SPC (credit protection service).
M. 14.5% interest will be charged per year on amounts and pending issues not settled with NewSky, whether in arrears, cancellation fines, or any other pending issues that the customer has with NewSky.

10. DOCUMENTS
A. It is the customer's responsibility to keep documents and registration data always updated with NewSky. Communicate with NewSky via SMS, Facebook, WhatsApp, email or phone.
11. SUPPORT & CONTACT
A. NewSky does not support and is not responsible for software and applications used by the customer.
B. Service for technical support or payment issues will only be resolved during business hours Monday through Friday from 10:00 am to 5:00 pm. Closed on national holidays and weekends.
