CONTRACT AND CONDITIONS OF USE OF THE MÔNICA WIFI AND MÔNICA MOBILE PRE-PAID COMBO
VERSION 21 – ENGLISH

THE PURPOSE OF THESE TERMS IS TO REGULATE THE CONDITIONS APPLICABLE TO THE CONTRACTING, USE AND CANCELLATION OF SPECIFIC SERVICES AND BENEFITS OFFERED BY NEWSKY (“SERVICES”) THROUGH A MONTHLY SUBSCRIPTION. PLEASE READ THE TERMS AND ALL CONDITIONS BELOW CAREFULLY. BY NOT AGREEING, IN WHOLE OR IN PART, WITH THESE TERMS, AS WELL AS WITH ANY AMENDMENTS, CHANGES OR UPDATES, THE CUSTOMER WILL NOT BE ABLE TO ACCESS THE SERVICES.

WHEREAS: NewSky offers the possibility for the customer to contract services and benefits through a monthly subscription;
THE PARTIES RESOLVE to enter into this SERVICE CONTRACT AGREEMENT OR SPECIFIC BENEFIT BY SUBSCRIPTION (“Term”), which will be governed in accordance with the following terms and conditions:

2. SERVICE
A. PREPAID service combined with Mônica Wifi mobile internet of excellent quality, with coverage (3G/4G), and Mônica Mobile telephone line chip with internet, calls and SMS, with area coverage available wherever there is 3G/4G from Docomo. The SIM card only works with DOCOMO or unlocked devices with a 3G/4G system compatible with the DOCOMO network.

PLAN DETAILS

ACTIVATION FEE (WIFI + CHIP): ¥6,600 for 0 promotional value

A. Receiving messages via SMS is unlimited and free. Sending up to 10 SMS messages to Japanese operators within Japan will be courtesy of NewSky, however sending more than 10 SMS has a cost of ¥20 per message for Japan and ¥150 for international sending. To avoid additional costs, we recommend using applications such as WhatsApp, Messenger, etc.;

B. FREE 60 MINUTE CALLS PLAN: The plan has 60 minutes of free calls to cell phones or homes for all operators in Japan. However, calls to paid numbers, such as 104/050/0570 among others, will be charged. After using the free 60 minutes, you will be charged ¥44 every 60 seconds;

C. WIFI - NO DAILY LIMIT*: *For plans with a Wi-Fi data allowance (35GB, 105GB), after using the entire data allowance, the speed will be reduced for a brief period, and then it will stop working, returning to normal the following month. For chip data plans (10GB, 35GB), after full consumption, mobile data service will be suspended until the next cycle;

D. UNLIMITED PLUS: Recommended for up to two people on 2 or 3 devices, for fair use; speed up to 4 Mbps, suitable for videos up to 720p; not recommended for frequent downloads. Use of more than 8GB daily may cause speed reduction or signal interruption without prior warning;

E. *We warn that uninterrupted use with a frequency of more than 5GB daily in the plan with a monthly allowance (Wi-Fi or chip), or 8GB daily in the UNLIMITED PLUS plan, may cause a reduction in speed, signal cutting without prior notice, and even the cancellation of the contract at the request of the operator or the Japanese government;

4. MÔNICA WIFI ROUTER DEVICE AND SIM CARD
A. The Mônica Wifi Router is provided on loan, at no additional cost, as long as it is returned in perfect condition at the end of the contract or when the customer no longer wishes to use the service. In case of loss, damage or non-return, a fee of ¥12,800 (original value of the device) will be charged.
B. The ROTADOR MÔNICA WIFI device is already configured and ready for use. We recommend that you do not make any changes or adjustments to the device settings.
C. Remanufactured Model: The model offered in this contract is RF and may contain signs of use.
D. Do not use the Mônica Wifi internet in the month you want to cancel; If used, the monthly fee will be charged in full.
E. The Mônica Mobile SIM Card is sent to the address registered in the customer's document and only the customer can receive it, upon confirmation of the document at the time of delivery.

5. PREPAID SERVICE, PAYMENTS, DATES, METHODS AND DEADLINES

CREDIT CARD

KONBINI

Payment will be processed by the 9th of the month of use.

Payment via konbini must be made by the 15th of the month of use.

We recommend that you have sufficient balance in your account by the 15th of each month.

To pay at KONBINI you need to provide us with a valid email address. Every month you will receive a new code in your email from the 2nd.

Provide billing information during service.

Payment at convenience stores: Family Mart, Lawson and Mini Stop.

A. The monthly fee refers to the month of use and must be paid by the 15th of the respective month (e.g.: use in April, payment by April 15th). If payment is not made by the 15th, the service will be suspended and fees and fines will be applied, if any.
B. For payments after the deadline, when negotiated until the 25th of the month of use, there will be a fee of ¥1,500. If there is no payment by the 25th, the contract will be canceled and the equipment (router and SIM card) must be returned.
C. If you wish to change the payment method from KONBINI to CREDIT CARD or vice versa, the customer must contact our call center at least 30 days in advance of the payment date.
D. BILLING FEE: ¥330
I understand that this [konbini/credit card] payment fee of ¥330 is currently being paid by NewSky, but may be added to the invoice at any time without notice.
E. PAYMENT TERMS CLAUSE

  • Initial Payment: To purchase the combined service, the customer must pay the current promotional price.
  • Monthly fees: The monthly fee is charged for the month of use, due by the 15th of each month.
  • Return of the Chip and Router: The customer is responsible for returning the SIM card and the Mônica Wifi router at the end of the contract or in case of cancellation by the 3rd of the month following the last paid month (e.g.: last use in April, return by May 3rd). If they are not returned or if they are used after the 3rd, the monthly fee for the following month will be charged in full. Fee for non-return or loss: ¥2,200 (chip) + ¥12,800 (router).
  • Fee for late return of the device will be ¥500 per day from the 4th.

6. CHANGE OF PLAN
A. To applyTo change your plan (Wi-Fi, chip or both), make the request to our center by the 5th of the month of use so that the change can be made the following month.
After the 6th, it will be processed the following month. Change fee valuecombined plan fee is ¥2,200. After payment of the change, it will come into effect from the first day of the following month, if the monthly fee is paid by the 15th.

7. CANCELLATION AND ABANDONMENT OF CONTRACT - MONTHLY CONTRACT - NO CANCELLATION FEE
A. To cancel the service, the holder must first pay the invoice and then contact NewSky by, at the latest, the 25th of the current month to request cancellation.

B. The customer must pay the monthly fee for the last month of use by the 15th and return the router and SIM card by the 3rd of the following month. Using the service will result in the full monthly fee being charged. CONTRACT ABANDONMENT DATE: 25th (if there is no payment by this date - only with prior negotiation with NewSky).
C. The amounts due must be paid by KONBINI or credit card. For billing via KONBINI or credit card, if there is a need to launch a new charge or change the payment date, there will be a fee of ¥1,500 added to the amount.

8. CONTRACT, DATA TRAFFIC & SUSPENSION RIGHTS
A. Please be advised that since January 2016, Japanese data traffic control laws have become stricter. New operator or government regulations may apply without prior notice, including restrictions on the volume of data traffic.
B. We provide adequate data capacity for general use. However, to ensure network quality and fair use, restrictions may be applied to users who perform intensive activities, such as large volumes of communication, downloads of large files or large videos. In these cases, actions such as interrupting the connection or significantly reducing speed may be implemented. This service is recommended for general use and is not suitable for torrent, P2P or similar activities. More details at: bit.ly/ns_pirataria.
C. Customers who consume large amounts of data should be aware of possible restrictions. In case of suspension or speed limitation imposed by the operator or the government, there will be no refund, exchange or compensation. NewSky is also not responsible for signal failures in certain areas.
D. In case of delay or abandonment of a service contract, NewSky reserves the right to suspend any other active customer service, without prior notice.
E. NewSky reserves the right to unilaterally suspend or cancel the customer's contract if it finds damage to the company, misuse, or misconduct on the part of the customer (e.g.: excessive connections or use of data beyond what is permitted). This may occur without prior notice, without refund and with the imposition of fines and fees, as applicable.
F. We recommend that the customer does not change the router settings, as the device is already configured and ready for use.
G. In the event of service interruption due to accidents or unscheduled maintenance, there will be no financial compensation for the period of unavailability.
H. NewSky reserves the right to pass on to the customer any changes to the services provided by the operator, including price adjustments, in accordance with current regulations, without the need for prior notice.
I. The service is prepaid and refers to the month of use. Once you have used the service, payment is due until the 15th, with no possibility of refund for partial use.
J. The maximum communication speed advertised for the device and service is based on theoretical values ​​and may not reflect actual speed. Connection speed may vary due to user environment (such as device specifications) and network congestion.
K. Pending debts or debts may be collected abroad, and the customer's name may be included in the SPC (Credit Protection Service) in case of default.
L. An annual interest rate of 14.5% will be applied to amounts owed, including outstanding monthly payments or other outstanding issues with NewSky.
M. In case of default with NewSky, accompanied by lack of payment and lack of communication or interest in resolving the pending issue, the fines stipulated for the clauses or agreements not complied with by the customer will be applied. The charge will be carried out by our legal representative, the law firm Libra Legal Office and/or Trade’s Creditor Protection Co., Ltd., who will assume responsibility for the case. Depending on the situation, legal action may be initiated. Customer documents and registration information may be used for legal resolution, and your name may be registered with the Credit Protection Service (SPC) in Japan and international institutions. All legal disputes will be resolved at the Tokyo Court of Justice.

10. DOCUMENTS
A. During this campaign, NewSky may request documents from the customer, who is responsible for keeping their registration data always updated with NewSky. For updates or other communications, please contact NewSky via SMS, Facebook, WhatsApp, email or phone.

11. SUPPORT & CONTACT
A. NewSky does not support or be responsible for software and applications used by the customer.
B. Mônica Mobile uses the Docomo network, but all support is exclusively offered by NewSky, where Docomo has no responsibility.
C. Technical support or questions regarding payments will only be resolved within business hours from Monday to Friday from 10:00 am to 5:00 pm. Closed on national holidays and weekends.
