The purpose of this term is to regulate the conditions applicable to the contracting, use and cancellation of the services and benefits offered by NewSky Especificos ("Services") through a monthly subscription. Please read the terms and conditions below carefully. By not agreeing, in whole or in part, with these terms, as well as any additions, changes or updates, the customer will not be able to access the services.

2. SERVICE

A. Telephone line chip with internet and SMS, with area coverage available where Docomo 3G/4G is available. The SIM card only works with DOCOMO or unlocked devices with a 3G/4G system compatible with the DOCOMO network.

A. ◼︎Receiving messages via SMS is unlimited and free. Sending up to 10 SMS messages to Japanese carriers within Japan will be courtesy of NewSky, however sending more than 10 SMS will cost ¥20 per message to Japan and ¥150 for international shipments. To avoid additional costs, we recommend using applications such as WhatsApp, Telegram, Messenger, Skype, etc.;

B. ▲UNLIMITED FREE CALLS: The plan has a system of unlimited and free calls to cell phones or home calls, to all operators in Japanese territory. However, calls to paid numbers, such as 104/050/0570, among others, will be charged.

C. ◆60 MINUTES FREE CALL: The plan has 60 minutes of free calls every month to cell phones or home calls to all operators in Japanese territory. However, calls to paid numbers, such as 104/050/0570, among others, will be charged. After using the free 60 minutes, you will be charged ¥38 every 60 seconds.

SIM CARD AGREEMENT, 6 MONTHS

IF THE CONTRACT IS CANCELED BEFORE PAYMENT OF 6 MONTHLY FEES, THERE WILL BE A FINE OF ¥8,000.

IF THE CONTRACT IS CANCELED AFTER PAYING 6 MONTHLY FEES, THE CUSTOMER WILL BE EXEMPTED FROM THE SIM CARD CONTRACT CANCELLATION FINE.

HIRING THE SERVICE WITH SMARTPHONE CAMPAIGN OR FREE MONTHLY CHARGE

IF THE CONTRACT IS CANCELED BEFORE PAYING 6 MONTHLY FEES, THERE WILL BE A FINE OF ¥8,000 + VALUE OF THE SMARTPHONE. (SEE AMOUNT ON YOUR INVOICE)

IF THE CONTRACT IS CANCELED AFTER PAYING 6 MONTHLY FEES, THE CUSTOMER WILL BE EXEMPTED FROM THE SIM CARD CANCELLATION FINE, BUT MUST PAY THE FULL AMOUNT OF THE SMARTPHONE DESCRIBED IN THE INVOICE.

IF THE AGREEMENT IS CANCELED AFTER 12 MONTHLY FEES HAVE BEEN PAID, THE CUSTOMER WILL BE EXEMPTED FROM THE FINE OF THE CHIP AND THE VALUE OF THE SMARTPHONE.

The campaign is valid while supplies last or may be terminated at any time without prior notice.

CAMPAIGN RULE

◎You will only be able to take advantage of the discount promotion or free monthly fee or free product, discounted product, if you sign up for a 6-month contract and have paid a minimum of 12 monthly payments. If there is a cancellation before this deadline, the free monthly fee/free product must be paid in full, according to the amount described in the invoice/order, in addition to the amounts of contract termination fines and other fees, if any. 4. PAYMENT METHODS AND DATES

Make sure you have enough balance on your credit/debit card on the 9th as the card is charged. We recommend that you have at least ¥2,000 more in your account on the day of the debit or sufficient credit.

For payment at KONBINI you need to provide us with a valid email address.

Every month you will receive a new code in your email.

Payment instructions will be in your email.

Provide the billing data during the service.

Payment at convenience stores:

A. If you do not pay on time, your contract will not be renewed and will be canceled. Fees and fines will apply, if any.

B. For late payments, when traded within the maximum period up to the 25th of the same month, there will be a fee of ¥1,500. If payment is not made within this date, the service will not be renewed and will be canceled.

C. If you wish to change the payment method from KONBINI to CREDIT CARD or vice versa, the customer must contact our call center, at least 30 days in advance of the payment date.

D. COLLECTION FEE: ¥220

I am aware that this ¥220 [konbini/credit card] payment fee is currently being paid by NewSky, but may be added to the invoice at any time without prior notice.

5. IMPORTANT INFORMATION

A. MNP: This service has number portability, which allows you to switch operators and keep the same number. To transfer your line to another operator there is a transfer fee of ¥3,300. The deadline for informing the MNP It will take up to 3 business days after payment confirmation.

B. If the contract is canceled, it will not be possible to reactivate the service, and the telephone number will be lost (with no possibility of recovering it).

C. It is possible to use applications with this service, however, it will not be possible to verify age in the LINE application or similar. This service does not have an answering machine.

6. CHANGE OF PLAN

A. It is possible to increase or decrease the amount of GB within your plan. Request a change of plan with our central until the 20th. The change of plan will take effect from the beginning of the following month if the monthly fee is paid.

B. PLAN EXCHANGE

  • Plan change fee: ¥3,300.
  • In case of upgrading the plan, the amount of the difference must be paid immediately together with the plan change fee.
  • In case of downgrading the plan, the difference amount will be adjusted together with the plan change fee.
  • Plan exchange with chip replacement: ¥5,500 + shipping, if any; this fee must be paid at the time of requesting the plan change.
  • Payment will be made by KONBINI or credit card.

7. CANCELLATION

MINIMUM CONTRACT 6 MONTHS (service only)

A. To cancel the service, the cardholder must contact NewSky and request the cancellation of the service.

B. The customer must pay the sums owed to NewSky within the stipulated period;

C. On or after cancellation, the SIM card must be returned to NewSky. See details of your contract on your invoice. Cancellation before the expiration of the contract will incur a penalty; After the term of the contract has been fulfilled, it may be canceled without a contract penalty;

D. Upon completion of the contract term, it may be canceled without contract penalty;

E. In case of a fine, it will be charged through KONBINI or credit card. For billing through KONBINI or credit card, once the billing has been launched, if there is a need to issue a new billing or change the payment date, there will be a fee of ¥1,000 added to the fine amount.

F. With the non-payment of the monthly fee by the 25th of the month of payment, and the lack of interest or lack of communication with NewSky, the fines referring to the clauses not fulfilled by the customer will be applied, which will be charged by our legal representative, the Libra Legal Office and/or Trade's Creditor Protection Co.ltd. being responsible for the case from that moment and, depending on the case, a lawsuit will be opened in the court of law in the jurisdiction of Tokyo. Documents and general information will be used for settlement by legal means and in addition, your name may also be registered with the CREDIT PROTECTION OFFICE in Japan and abroad. Any legal disputes will be resolved with the Tokyo Court of Justice.

G. If there is any promotion or free monthly fee, the bonus month of the promotion will NOT count within the 6 month term of the contract. The customer must pay every month of the contract, regardless of whether there is a promotion. Example: If the contract is for 6 months with a 1 month free promotion, the customer MUST pay the 6 monthly fees (instead of 5), as the promotion will not enter this period.

If the SIM card is lost or stolen, and the customer no longer wishes to use the service, the customer must pay the fine for canceling the contract (if the contract term has not been met).

The extra fee (SMS/Paid Calls/Etc) will be charged later with a period of between 30 and 90 days and will be charged separately from the monthly fee and will be active for payment on the same KONBINI/credit card according to the contracted plan.

9. CONTRACT, DATA TRAFFIC & SUSPENSION RIGHTS

A. Please be advised that as of January 2016, Japanese data traffic control laws have been tightened. New rules from operators or the government may occur without prior notice. Restrictions on data traffic volume may apply.

B. We provide adequate data capacity for general use, but from the point of view of fair use and maintaining network quality, usage restriction may apply to users who communicate in large quantities, download large files, videos long, etc. In these cases, measures can be taken, such as interrupting the communication or extremely slowing down the communication speed.

C. Customers who consume large amounts of data need to be careful. *Will not be refunded or exchanged, etc. in case suspension measures or speed restrictions are applied by the operator or the government. NewSky is not responsible for signal failures in some areas.

E. In case of delay or abandonment of a service contract, if the customer has another active service, NewSky reserves the right to suspend the other service without prior notice.

F. NewSky reserves the right to unilaterally suspend or cancel the customer's contract, if it causes damage to the company or in case the company deems misuse or misconduct, such as excessive or consecutive calls for a long period by of the customer. Suspension may be made without prior notice and without compensation.

G. In case of suspension of the service due to accidents, unscheduled maintenance on the system or oscillations in the data network, there will be no reimbursement for the time of unavailability of the service.

H. NewSky reserves the right, in the event of any change in the service by the operator, to transfer this change to the customer without prior notice, obeying the rules thus required, including value adjustments.

I. Cheap data package service with. Internet speed during use may vary due to user environment (such as endpoint device specifications) and network congestion.

J. The collection of pendencies or debts can also be done abroad. The customer may have his name included in the SPC (credit protection service).

K. 14.5% interest per year will be charged on amounts and pending issues not settled with NewSky, whether overdue monthly fees, cancellation fines, or any other pending issue that the customer may have with NewSky.

L. The SIM Card must be returned at the end of the contract.

10. DOCUMENTS

A. It is the customer's responsibility to keep documents and registration data always updated with NewSky. NewSky communicates with customers via SMS, Facebook, WhatsApp, email, telephone or letter.

11. LOSS OR THEFT

A. In the event of loss or theft, the customer must immediately file a police report at the nearest police station or KOBAN. *This process is mandatory in case of loss or theft of a cell phone with a SIM CARD.

12. CONNECTION CHIP DELIVERY METHOD

A. The SIM CARD is sent to the address registered in the customer's document and only he can receive it, upon confirmation of the document at the time of delivery.

B. Prior to receiving the package, the customer will receive a notification from the courier. With the notification in hand, the customer must call the post office and schedule the day and time for delivery, or go to the post office in person and pick it up. It is necessary to present the notification and identification document.

13. SUPPORT

A. NewSky does not support and is not responsible for software and applications used by the customer.

B. MÔNICA MOBILE uses the Docomo network, but all support is offered exclusively by NewSky, where Docomo has no responsibility;

C. Service for technical support or questions regarding late payment will only be resolved within the opening hours of the responsible department: Monday to Friday from 10:00 am to 5:00 pm (closed on weekends and national holidays) .
