CONTRACT OF SIM CARD OF CALLS MONICA MOBILE

These terms and conditions govern the terms and conditions applicable to the contracting, use, and cancellation of the services and benefits offered by NewSky Específicos ("Services") through a monthly subscription. Please read these terms and conditions carefully. If you do not agree, in whole or in part, to these terms and conditions, as well as any amendments, changes, or updates, you will not be able to access the services.
1. WHEREAS: NewSky offers the possibility for the customer to contract services and benefits through a monthly subscription; The Parties RESOLVE to enter into this TERM OF CONTRACT FOR SERVICES OR SPECIFIC BENEFIT BY SUBSCRIPTION ("Term"), which will be governed in accordance with the following terms and conditions:
2. PREPAID SERVICE
A. A phone line SIM card with internet and SMS, with area coverage available wherever Docomo 4G/LTE is available. The SIM card only works with DOCOMO devices or unlocked devices with a 4G/LTE system compatible with the DOCOMO network.

A. ◼︎Receiving SMS messages is unlimited and free. Sending up to 10 SMS messages to Japanese carriers within Japan is free of charge from NewSky. However, sending more than 10 SMS messages costs ¥20 per message within Japan and ¥150 for international messages. To avoid additional costs, we recommend using apps like WhatsApp, Telegram, Messenger, Skype, etc.; | |||||||
B. UNLIMITED CALLING PLAN: This plan offers unlimited, free calls to cell phones and homes, to all carriers in Japan. However, calls to toll-free numbers, such as 104/050/0570, among others, will be charged. | |||||||
C. ◆60-MINUTE FREE CALLING PLAN: This plan includes 60 minutes of free calls to mobile phones or homes for all carriers in Japan. However, calls to toll-free numbers, such as 104/050/0570, will be charged. After using the 60 free minutes, you will be charged ¥44 for every 60 seconds. | |||||||

4. PAYMENT METHODS AND DATES

A. If you do not make payment on time, your contract will not be renewed and will be canceled at the end of the month and you will be charged the current monthly fee and fees and penalties will be applied, if any. | ||

C. If you wish to change the payment method from KONBINI to CREDIT CARD or vice versa, the customer must contact our customer service center at least 30 days before the payment date. | ||
D. CHARGE FEE: ¥330 I understand that this payment fee [konbini/credit card] of ¥330 is currently being paid by NewSky, but it may be added to the invoice at any time without prior notice. | ||
E. PAYMENT CONDITIONS CLAUSE Down payment:To purchase the connection chip service, the customer must pay the first monthly fee in advance, as well as the chip acquisition fee of ¥2,200. These amounts are paid in advance and guarantee the start of the service. Future Monthly Payments:After the initial payment, subsequent monthly installments must be paid in the current month. Chip Return:The customer is responsible for returning the SIM card at the end of the contract or in the event of service cancellation by the 5th of the following month. Failure to return the SIM card within the stipulated period will result in an additional ¥2,200 fee for failure to return or loss of the SIM card. | ||
5. IMPORTANT INFORMATION
A. MNP: This service offers number portability, which allows you to switch carriers and keep the same number. Transferring your line to another carrier involves a transfer fee of ¥3,300. The deadline forinform the MNPwill be up to 3 business days after payment confirmation. | |||||
B. If the contract is canceled, it will not be possible to reactivate the service, and the telephone number will be lost (without the possibility of recovering it). | |||||
C. It is possible to use apps with this service, however, it will not be possible to perform age verification on the LINE app or similar apps. This service does not have an answering machine. | |||||
D. eSIM (chip virtual) The eSIM is a virtual SIM card, delivered digitally immediately after purchasing a plan. To use it, the customer must have an unlocked device compatible with eSIM technology. It is not possible to switch between a plan with an eSIM and a plan with a physical SIM card (SIM card). If the device is lost or needs to be reinstalled or reissued, a fee of ¥5,500 will be required. Depending on the situation, it may be necessary to purchase a new eSIM with a new number. The customer must provide the device's EID to proceed with activation and ensure the device is unlocked and compatible with Docomo. Once the eSIM cancellation is requested, the process is irreversible, and a new number will need to be issued. |
6. CHANGE OF PLAN
A. You can increase or decrease the number of GB within your plan. Request a plan change with our center by the 20th. The plan change will take effect at the beginning of the following month if the monthly fee has been paid. | ||

7. CANCELLATION
MONTHLY CONTRACT | |
A. To cancel the service, the holder must first pay the invoice and then contact NewSky by the 25th of the current month at the latest to request cancellation. | |
B. The customer must pay the amounts owed to NewSky within the stipulated period; | |
C. If you cancel within the deadline or after, the SIM card must be returned to NewSky. See your invoice for contract details. | |
D. In the event of a fine, it will be charged via KONBINI or credit card. For charges via KONBINI or credit card, once the charge has been issued, if a new charge needs to be issued or the payment date changed, a ¥1,000 fee will be added to the fine amount. Resending an invoice may incur a ¥1,000 fee. | |
E. If the monthly fee is not paid by the 25th of the month due, and there is a lack of interest or communication with NewSky, fines related to the terms and conditions not complied with by the customer will be applied. These fines will be collected by our legal representative, Libra Legal Office and/or Trade's Creditor Protection Co. Ltd., who will be responsible for the case from that moment onward. Depending on the case, a lawsuit may be filed with the Tokyo Court of Justice. Documents and general information will be used for legal resolution, and your name may also be registered with the CREDIT PROTECTION SERVICE in Japan and overseas. Any legal disputes will be resolved by the Tokyo Court of Justice. |

IMPORTANT The extra fee (SMS/Paid calls/Etc.) will be charged later within 30 to 90 days and will be charged separately from the monthly fee and will be active for payment via KONBINI/credit card according to the contracted plan. | ||
9. CONTRACT, DATA TRAFFIC & SUSPENSION RIGHTS
A. Please be advised that as of January 2016, Japanese data traffic control laws have become stricter. New regulations from carriers or the government may be introduced without prior notice. Restrictions on data traffic volume may apply.
B. We provide adequate data capacity for general use, but from the perspective of fair use and maintaining network quality, usage restrictions may apply to users who communicate in large quantities, download large files, or watch very long videos, etc. In these cases, measures may be taken, such as interrupting communication or severely reducing communication speed.
C. Customers who consume large amounts of data need to be careful. *Refunds, exchanges, etc. will not be provided if the carrier or government imposes suspension or speed restrictions. NewSky is not responsible for signal outages in some areas.

E. In case of delay or abandonment of a service contract, if the customer has another active service, NewSky reserves the right to suspend the other service without prior notice.
F. NewSky reserves the right to unilaterally suspend or cancel a customer's contract if the contract causes harm to the company or if the company deems it to be misused or misconducted, such as excessive or consecutive calls for a long period of time. Suspension may be made without prior notice and without compensation.
G. In the event of service suspension due to accidents, unscheduled system maintenance or fluctuations in the data network, there will be no reimbursement for the time the service is unavailable.
H. NewSky reserves the right, in the event of any change in service by the operator, to pass this change on to the customer without prior notice, complying with the required rules, including price adjustments.
I. Service with economical data package with. Internet speed during use may vary due to the user's environment (such as terminal device specifications) and network congestion.
J. Collection of outstanding debts may also be made abroad. The customer's name may be included in the SPC (credit protection service).
K. 14.5% interest per year will be charged on amounts and outstanding debts with NewSky, whether overdue monthly payments, cancellation fees, or any other outstanding debt that the customer may have with NewSky.
L. The SIM Card must be returned at the end of the contract.
10. DOCUMENTS
A. It is the customer's responsibility to keep their documents and registration data updated with NewSky. NewSky communicates with customers via SMS, Facebook, WhatsApp, email, phone, or letter.
11. LOSS OR THEFT
A. In the event of loss or theft, the customer must immediately file a police report at the nearest police station or KOBAN. *This process is mandatory in the event of loss or theft of a cell phone with a SIM card.
12. CALLING CHIP DELIVERY METHOD
A. The SIM CARD is sent to the address registered on the customer's document and only the customer can receive it, upon confirmation of the document at the time of delivery.
B. Before receiving the package, the customer will receive a notification from the post office. With the notification in hand, the customer should call the post office and schedule a delivery date and time, or go to the post office in person to pick it up. The notification and identification must be presented.
13. SUPPORT
A. NewSky does not offer support or take responsibility for software and applications used by the customer.
B. MÔNICA MOBILE uses the Docomo network, but all support is exclusively offered by NewSky, for which Docomo has no responsibility;
C. Technical support or issues regarding late payments will only be resolved within the business hours of the responsible department: Monday to Friday from 10:00 am to 5:00 pm (closed on weekends and national holidays).
